NEC contract cheat sheet for subcontractors

Use your NEC subcontract actively: keep the programme current, notify risks and changes separately, and support every payment application.

Before you start

Use this as a quick operational checklist, not a complete contract summary. Keep the signed form, amendments and project dates beside it.

For NEC4 Engineering and Construction Subcontract (ECS) packages. The Engineering and Construction Short Subcontract (ECSS) has different procedures. Check the edition, main option, Contract Data, Scope and Z clauses. Your contractual contact is the Contractor; the main-contract Project Manager is not automatically your administrator.

Step-by-step guide

  1. 1. Turn the subcontract into a working diary

Do this: Record Scope, access, design duties, programme requirements and completion obligations. Identify authorised communications and response periods. Align your programme with agreed interfaces and keep updates traceable.

Watch for: Copying the main ECC timetable can miss shorter or different subcontract deadlines. Programme acceptance does not itself change a contractual completion date.

Subcontract management and administration can help turn the agreed terms into a working diary of duties and notices.

  2. 2. Apply using your form and main option

Do this: Submit the application and supporting records by the subcontract deadline. Follow the chosen valuation basis, then reconcile the assessment and cash. Use the NEC payment guide.

Watch for: ECS and ECSS payment mechanisms differ. NEC's ECSS guidance explains why the subcontractor must follow that form's application requirements.

  3. 3. Give early warnings and event notices separately

Do this: Warn the Contractor when a matter threatens cost, completion or performance. Separately notify a potential compensation event under the subcontract. Follow quotation instructions and record cost and programme effects.

Watch for: An early warning is not a compensation-event notice. Do not import ECC's eight-week period into an ECS or ECSS subcontract; check your actual time bar.

  4. 4. Keep the programme connected to the event

Do this: Preserve the relevant programme and progress records. Explain the event's effect on remaining work, mitigation and forecast completion. Submit revised programmes and quotations through their separate procedures.

Watch for: A longer site presence alone does not prove all claimed delay costs. Link the event, affected work and forecast assessment.

  5. 5. Track close-out and unresolved assessments

Do this: Check the Scope requirements for Completion, defects and handover. Follow the final-assessment process and diarise challenge deadlines. Identify any selected retention or delay-damages options.

Watch for: The client's use of the main works may not trigger your release. Keep your completion evidence and use the final-account reconciliation guide.

Before you finish: Write down the next action, its owner, deadline and delivery method. Get advice on uncertain rights before an irreversible step.

Worked example

The facts

Fictional example: an NEC4 ECS subcontractor warns that access may be late. Access is subsequently unavailable when required.

What happens

  1. It checks the compensation-event provisions and sends the required separate notification to the Contractor.

  2. It preserves access and programme records, then follows the instructed quotation procedure.

What this shows

The early warning supports risk management; the separate event procedure protects the subcontract assessment process.
