NEC contract cheat sheet for clients

Make NEC4 work from the client side: resource the Project Manager, provide timely decisions and keep payment and change assessments moving.

Before you start

Use this as a quick operational checklist, not a complete contract summary. Keep the signed form, amendments and project dates beside it.

For clients under NEC4 Engineering and Construction Contract (ECC). The main option, secondary options, Contract Data, Scope and Z clauses shape your obligations. Other NEC contracts differ. NEC's process guidance connects early warnings, programmes and compensation events.

Step-by-step guide

  1. 1. Equip the team to administer the contract

Do this: Appoint the Project Manager and Supervisor and confirm their authority. Allocate client access, information and decision duties. Set a diary for submissions, replies and escalation when cover is needed.

Watch for: A named administrator without time or authority cannot keep the process moving. Internal approval arrangements do not automatically extend contractual response periods.

Client contract management support can help turn the agreed terms into a working diary of duties and notices.

  2. 2. Resource assessment, certification and payment

Do this: Ensure the Project Manager assesses under the selected option and certifies on time. Arrange payment and any required notices under the actual mechanism. Use the NEC payment guide.

Watch for: An internal invoice approval queue does not reset a contract deadline. Check any Y(UK)2 provisions and applicable legislation before using a generic diary.

  3. 3. Make risk meetings and change decisions productive

Do this: Ensure early warnings reach the right people and agreed mitigation has owners. The Project Manager should instruct, notify, request quotations and respond through the compensation-event procedure.

Watch for: An early-warning meeting does not replace notices or quotations. Silence can have contractual consequences; check the further-notice steps before assuming deemed acceptance.

  4. 4. Provide decisions and test the programme effects

Do this: Track client information and access against required dates. Ensure programme submissions receive timely responses. Assess event impacts on cost and dates using the contract's rules and stated assumptions.

Watch for: Programme acceptance alone does not grant an extension. The selected main option also changes financial risk; understand Defined Cost and option differences.

  5. 5. Plan take over, defects and the final assessment

Do this: Arrange the Completion assessment, take-over arrangements and defects process. Check Scope deliverables, bonds, retention options and the final account. Preserve the final-assessment and dispute timetable.

Watch for: Take over and Completion are separate concepts. Do not assume occupation ends every contractor obligation or releases every security.

Before you finish: Write down the next action, its owner, deadline and delivery method. Get advice on uncertain rights before an irreversible step.

Worked example

The facts

Fictional example: an NEC4 client team delays a design decision while a contractor's programme and quotation await responses.

What happens

  1. The client assigns the decision to an authorised person and the Project Manager checks each live response deadline.

  2. The programme and event quotation receive separate contractual responses, with the decision and assumptions recorded.

What this shows

Client decision-making supports the live contract processes rather than leaving unanswered submissions in an approval queue.
