NEC contract cheat sheet for main contractors

Run an NEC4 main contract through its live processes: applications, early warnings, compensation events, programmes and timely responses.

Before you start

Use this as a quick operational checklist, not a complete contract summary. Keep the signed form, amendments and project dates beside it.

For NEC4 Engineering and Construction Contract (ECC), subject to the selected main option, secondary options, Contract Data, Scope and Z clauses. ECS and ECSS subcontracts have separate rules. NEC3 wording must be checked separately. NEC explains the links between its management processes.

Step-by-step guide

  1. 1. Keep the programme and communications current

Do this: Identify Project Manager and Supervisor responsibilities. Submit programmes with the required information, answer comments and update progress. Record separate notice deadlines and the agreed communication system.

Watch for: An accepted programme is not automatic agreement to extra time or money. Missed submissions can affect assessment and payment.

Main-contract and subcontract administration support can help turn the agreed terms into a working diary of duties and notices.

  2. 2. Match the application to the main option

Do this: Submit the application before the assessment date. Support the applicable activity, quantity or Defined Cost basis. Reconcile certificates and payment separately from subcontract liabilities. See the NEC payment guide.

Watch for: Ordinary payment and compensation-event valuation use different rules. NEC's Defined Cost guidance explains why the selected option matters.

  3. 3. Notify the event, then follow the quotation process

Do this: Give an early warning for a developing risk and a separate compensation-event notice where required. Record awareness, notification, response and quotation dates. Submit the forecast cost and programme impact together.

Watch for: Unamended NEC4 ECC clause 61.3 generally sets an eight-week awareness time bar, with stated exceptions. NEC explains the clause. Do not wait for complete costs.

  4. 4. Assess effects against the relevant programme

Do this: Identify affected operations and the relevant accepted programme. Explain changes to planned Completion and any Key Date. Record mitigation, assessment assumptions and the dividing date used for the event.

Watch for: A retrospective total-cost claim may not follow NEC's event-assessment rules. Distinguish an instructed change from your own performance problem.

  5. 5. Complete the closing processes on both sides

Do this: Track Completion, take over, defects and the final assessment. Reconcile implemented events and subcontract positions. Diarise the applicable dispute route and finality deadlines.

Watch for: Finishing on site does not settle the account. A late final submission does not revive a time-barred event; preserve the event record throughout.

Before you finish: Write down the next action, its owner, deadline and delivery method. Get advice on uncertain rights before an irreversible step.

Worked example

The facts

Fictional example: an NEC4 ECC contractor receives an instruction changing an access arrangement and records only an early warning.

What happens

  1. It checks which party must notify the compensation event and follows the relevant procedure separately.

  2. Its quotation explains forecast resources and effects on the relevant programme, with assumptions identified.

What this shows

The change is assessed through the compensation-event process instead of being left as an unpriced risk-register entry.
