Concurrent delay requires analysis of the effect of each cause, not just matching dates in a diary. Two problems occurring during the same week may affect different activities, or only one may control completion. Explain the relevant periods and the programme effect of each cause. The contractual and legal treatment of time and money should be considered separately.
Preserve the programme updates and contemporaneous records for both causes, including material that weakens your own position. Obtain appropriate advice on the applicable test. Start with the delay and disruption comparison. Our Delay and disruption cost recovery examines claimed commercial loss and evidence, with separate specialist input where the programme or legal analysis requires it.
