Entitlement

The contractual or other legal basis for the remedy being claimed, such as additional payment or time.

Further detail

Entitlement connects the facts to a contractual or other legal basis for a remedy. Identify the relevant obligation, risk allocation and conditions, including amendments. Explain why they apply to this event and address any exceptions or competing explanation. A loss incurred on a project is not automatically a loss recoverable from the other party.

Separate the basis of the claim from its valuation. A Claim viability review can help assess the contractual position, supporting records and proportionate next step.
