Will Compensation Event Loss Prevention work to our amended periods or the standard NEC ones?

To your amended ones: every period is read from your signed subcontract and its amendment schedule, never assumed from the standard form.

Updated: . By Jack Butler-Kettle, Construction Claims Consultant.

The answer

We start from the signed subcontract: the form and main option, the amendments, and who notifies whom through which communication system. We read the notification period and its exceptions, the quotation and reply periods, and what the Schedule of Cost Components lets a quotation contain. Those go on one page, and the routine is built around them. It has an event log that records the awareness date and its evidence the day an event lands, and a live early warning register. It has a notification template sent through the right channel, a quotation template in the contract's own cost shape, and a diary that counts every clock. Your team runs it for a live month with us alongside. We check every event the month produced against its period, then correct the routine and hand it over. The set-up and the live month are a fixed fee, agreed in writing before the work starts.

Example

Illustrative example. The scenario and figures are invented.

The facts

A drylining subcontractor works under an NEC subcontract whose amendments cut the notification period to 4 weeks. They also make the main contractor's project manager, through its document system, the only valid recipient. The team remembers 8 weeks from other jobs.

What happens

  1. The signed subcontract and its amendments are read, and the 4 weeks, the recipient and the channel go on the one-page map.
  2. The diary counts each event's notification deadline from its awareness date on the 4-week period, not the 8 weeks the team remembers.
  3. In the live month two events are logged, each with its evidence of awareness and a deadline 4 weeks out.
  4. Both are notified through the document system in time, and each is checked against its clock before handover.

The outcome

The routine runs to the periods in the signed subcontract, so the team is no longer counting from a standard form it has not signed.
