# Tender: definition and example

An offer to carry out work on stated documents, pricing assumptions and qualifications, subject to the subsequent agreement.

## What it means in practice

A tender is an offer made on stated documents, assumptions and qualifications. Whether and how it becomes part of the contract depends on the subsequent agreement. Later orders, amendments and clarifications can change the position, so the final document set must be reconciled.

## Worked example

### The facts

A specialist's tender excludes weekend working, but the proposed order requires a seven-day programme.

### What happens

1.  It compares the proposed order against the tender qualifications.
    
2.  It resolves the programme and price before treating the documents as an agreed package.
    

### What this shows

A qualification in the tender is not assumed to survive unchanged into every later agreement.
