# Suspension: definition and example

A temporary stopping of contractual performance under an applicable right, such as statutory suspension for qualifying non-payment after the required notice.

## What it means in practice

Read this alongside [section 112 of the Housing Grants, Construction and Regeneration Act 1996](<https://www.legislation.gov.uk/ukpga/1996/53/section/112>).

Statutory suspension for non-payment is a specific remedy with conditions, including a qualifying unpaid sum and notice of intention to suspend. It differs from termination and from simply abandoning the works. The applicable legislation and contract should be checked before any action is taken.

1.  It verifies the amount payable and the documents governing that cycle.
    
2.  It checks the statutory notice requirements and obtains advice before changing site attendance.

An overdue payment prompts an assessment of the remedy; it does not make an immediate unnotified stoppage safe.
