# Default Payment Notice: definition and example

A payee notice used within the applicable payment mechanism after a missing payer notice, subject to the contract and statutory requirements.

## What it means in practice

Read this alongside [section 110B of the Housing Grants, Construction and Regeneration Act 1996](<https://www.legislation.gov.uk/ukpga/1996/53/section/110B>).

This is part of the statutory payment-notice mechanism, not a general overdue-invoice reminder. A payer's failure may allow a payee notice, or an earlier qualifying application may already perform that role. Giving a later notice can affect the final date for payment under the applicable rules.

## Worked example

### The facts

The expected payer's notice does not arrive after a subcontractor's monthly application.

### What happens

1.  The subcontractor checks whether its earlier application qualifies under the agreed mechanism.
    
2.  If another notice is needed, it checks the content and effect on payment dates before service.
    

### What this shows

The appropriate document follows the payment mechanism, rather than simply being labelled a default notice.
